Athens-Clarke County Police Department has paid LexisNexis for the Accurint Virtual Crime Center every year since December 2019, and the contract it signed bars the department from discussing that arrangement publicly. Section 24 of the LexisNexis Master Terms states that the customer "will not name LN or refer to its use of the LN Services in any press releases, advertisements, promotional or marketing materials, or make any other third-party disclosures." A companion LexisNexis agreement the department signed for a second product goes further. Before releasing anything under the Georgia Open Records Act, ACCPD must give LexisNexis written notice and ten days to produce a statutory exemption or a court order blocking the release.
The AVCC deal was executed in stages in 2019. Chief Cleveland L. Spruill, Sr. signed the government application on August 5. Mayor Kelly Girtz signed the Master Terms on November 8, countersigned for LexisNexis by CEO Haywood Talcove. Captain Keith Kelley signed the Schedule A on November 15, committing $20,550 a year with a 3 percent annual escalator and automatic 12-month renewals. Purchase orders track every renewal since: $21,801.50, then $22,455.54, $23,129.21, and $23,823.09 for the year ending November 30, 2025. Each figure matches the escalator to the cent, which shows the subscription ran unbroken for six years.
Whether ACCPD feeds its records into the Public Safety Data Exchange, the national pool of police records that federal agencies including ICE can search, is unresolved. The department's LexisNexis file contains the addendum that creates the contribution obligation. Section I.2 commits the customer to contribute public safety information, and Section II.1 grants LexisNexis an irrevocable, worldwide license to compile, publish and distribute it. The copy released is the standard contributing version rather than the "NO DATA CONTRIBUTIONS TO PSDEX" variant that Duluth, Minnesota signed. It carries no signature, no date, and a blank ORI number. Until an executed copy surfaces, this record stays at probable contributor.
One thread narrows the gap. ACCPD launched the LexisNexis Community Crime Map in April 2021 and said the map "automatically syncs with ACCPD's records system." The same addendum governs Community Crime Map, and Section II.5 describes the public map as "a de-identified subset" of the data a customer contributes to PSDEX.
From 2017 to mid-2023 the department also ran the LexisNexis Desk Officer Reporting System, an online portal for residents and businesses to file police reports, at $1,562.50 a month. Under that agreement LexisNexis keeps a copy of every report for at least seven years and distributes reports "to individuals or legal entities" and to other law enforcement agencies. If the department cancels, LexisNexis has no obligation to delete anything and may keep distributing what it already holds. Installation required ACCPD to give LexisNexis VPN access to its records management system.
Georgia leaves residents no local remedy. O.C.G.A. § 36-80-23 bars every Georgia local government from adopting a sanctuary policy, and HB 1105 (2024) made refusal of an immigration detainer a criminal offense for sheriffs. Athens-Clarke County could not restrict this data sharing if it wanted to.
The commission has tried to slow the wider surveillance buildout. In June 2025 Commissioner Melissa Link moved to strip funding from the department's Real Time Crime Center, saying she feared laws "that might mandate that ACC Police share their surveillance information with federal agents." The motion failed and the commission funded seven positions at $419,000. The center opened September 27, 2025, pulling from more than 1,000 cameras, roughly 200 of them on the University of Georgia campus, plus Flock Safety license plate readers, facial recognition, and what a department analyst described to a local reporter as intelligence databases "such as Accurint."
That analyst, crime and intelligence analyst supervisor Nick Barker, said in the same interview that "every click of a button is audited." In August 2026 ACCPD fired him for repeatedly searching his ex-wife's license plate on the Flock system during 2025. The Georgia Bureau of Investigation opened a criminal investigation, and the department restricted Flock access to lieutenants and above.
Two records would close the remaining questions: the executed AVCC addendum showing the ORI number and signature date, and any LexisNexis audit log identifying which outside agencies have queried data contributed by Athens-Clarke County.

Product bundle differs slightly: it does not list AVCC itself in Sec 2.1. Also names Chris Ternus as LN Account Manager. Evidentiary value is that the deal was quoted twice across five months, which pins Ternus to the account through the whole negotiation.
Certificate of liability insurance for LexisNexis Risk Solutions FL Inc., issued by Aon Risk Services 2018-12-18. Routine procurement paperwork, filed for completeness of the fourteen-document production. Its only analytic value is the date, which places LexisNexis in the county's vendor pipeline about eight months before the Government Application was signed.

Purchase orders 49169 and 24101573 prove the service was nonetheless live and paid, roughly 2017 through June 2023 at $1,562.50/month. Provider is LexisNexis CLAIMS Solutions Inc. (Coplogic branding), a different corporate entity from LexisNexis Risk Solutions FL Inc., which holds the AVCC contract. Four clauses matter. Sec 8.5 requires the agency to notify LexisNexis before releasing records under the Georgia Open Records Act and gives the company ten days to obtain an exemption or protective order. Sec 8.9 has the agency agree to serve as a LexisNexis marketing reference including a published success story. Sec 3 requires LexisNexis to retain each report at least seven years and to distribute reports to Authorized Requestors and other agencies. Sec 6.3 says LexisNexis has no obligation to delete on termination and may keep distributing. Order No. 1 Sec 3.2 required the agency to give LexisNexis VPN access to its exporter and RMS applications and to hand over its database schema. Sec 7.4 bars the agency from sending SSNs.
The earlier version of the addendum, titled "Accurint Virtual Crime Center Addendum" and covering AVCC alone. Supplied in the Athens-Clarke production as ADDM_AVCC_(Q4_16_v1)_redline.docx. DESPITE THE FILENAME IT IS NOT A REDLINE: the file contains no tracked changes and no strikethrough text, only underlined headings. It is a clean vendor template. Do not report it as evidence Athens-Clarke negotiated the addendum. Its value is comparative: set against Q3.17.v1 it dates LexisNexis's merger of Community Crime Map into the same instrument that carries the PSDEX contribution obligation to somewhere between Q4 2016 and Q3 2017.

It IS the standard contributing variant, not the Duluth "NO DATA CONTRIBUTIONS TO PSDEX" variant: Sec I.2 contribution obligation present, Sec II.1 irrevocable license present. Because the copy is unexecuted it does not establish execution, and the agency is held at Probable Contributor rather than Confirmed.
