THE BARTER, IN WRITING. Agency Fee is stated as $0.00 ("There shall be no fee to Agency for the Services"). In exchange, LexisNexis takes the sole and exclusive right to sell Elk Grove's crash reports online and to distribute data extracted from them, through BuyCrash. Elk Grove takes no revenue share. Agency retains only the right to fulfill state FOI requests.
Sec 3.5 also carries reciprocity language: Agency allows Participating Agencies access to its Reports and receives access to theirs in return.
Initial term 36 months, auto-renewing in 12-month periods on 60 days' notice. DPPA permissible purpose selected: "Use by a government agency, but only in carrying out its functions."
Read alongside the master agreement's Sec 13, which caps LexisNexis liability at $100 where services are provided at no cost.
